1. Who we are and what these terms cover
FolioCart ("FolioCart", "we", "us") operates a managed marketplace for print services and office supplies in Nigeria. By browsing this website, requesting a quote, accepting a quote, or placing an order, you agree to these Terms of Service. If you do not agree, do not use the platform.
2. How the service works
- Print services: you submit a request with your specifications; we issue a quote. A contract is formed only when you accept a quote we have issued. Indicative price ranges shown on the site are estimates only and are not binding offers.
- Supplies: a contract is formed when we confirm your order. Prices and stock levels may change at any time before confirmation. Obvious pricing errors do not bind us, and we may cancel and refund any order placed at a clearly erroneous price.
- We fulfil print jobs through vetted third-party production partners, but your contract is with FolioCart only.
3. Your artwork and content
- You confirm you own, or are licensed to use, all artwork, logos, text and designs you submit.
- You indemnify FolioCart in full against any claim, loss, fine or cost arising from your content infringing a third party's intellectual property or any law.
- We may refuse any job that is unlawful, deceptive, infringing, or that we reasonably consider objectionable.
- You are responsible for proofreading. We print what you approve — errors in approved artwork (spelling, dates, phone numbers, colour choices) are not our responsibility.
4. Design support
- Where you ask FolioCart to create or adapt a design for you, a separate design fee applies. It is itemised in your quote alongside the print price.
- The design fee covers the agreed brief and up to two rounds of revisions; material changes to the brief may be re-quoted.
- Reference materials you provide must be ones you are entitled to share; designs we produce remain FolioCart's property until the related invoice is paid in full, after which usage rights transfer to you for the printed work.
5. Quotes, payment and delivery
- Quotes are valid for 7 days unless stated otherwise.
- Once you approve a quote and work commences, you are liable to pay in full. Full payment is required before production begins on print jobs and design work. Supplies orders may be paid upfront or on delivery.
- Turnaround and delivery timelines are good-faith estimates, not guarantees. We are not liable for delays caused by events outside our reasonable control (power, fuel, logistics disruptions, supplier failures, strikes, weather, or acts of government).
- Risk in goods passes to you on delivery to the address you provided.
6. Print tolerances
Commercial printing has inherent variation. Reasonable deviations in colour (screen-to-print differences), trimming (±2mm), paper batch, and quantity (±5% on bulk runs) are industry standard and do not constitute defects.
7. Returns and refunds
Returns and refunds are governed by our Refund Policy, which forms part of these terms.
8. Accounts
You are responsible for the confidentiality of your login details and for all activity under your account. We may suspend or close accounts that breach these terms, abuse our staff or partners, or attempt fraud.
9. Limitation of liability
- To the maximum extent permitted by law, FolioCart's total liability for any claim arising from an order is limited to the amount you paid for that order.
- We are not liable for indirect or consequential losses — including lost profits, lost business, missed events or deadlines, or reputational harm — even if advised of the possibility.
- Nothing in these terms excludes liability that cannot be excluded under Nigerian law.
10. General
- We may update these terms at any time; the version published on this page applies to new orders.
- These terms are governed by the laws of the Federal Republic of Nigeria, and disputes are subject to the courts of Lagos State.
- If any clause is found unenforceable, the rest remain in force.
